BREAKING - Miami Court Orders Take-Two to Turn Over “Bully”
October 11th, 2006
GamePolitics has just received a short e-mail from Jack Thompson:

“The court ordered production of the game by tomorrow at 3pm, for his full review of the game while it is being played, up to or more than 100 hours.”

“This is unprecedented and reasonable as well. This is a huge victory against the violent video game industry, regardless of the ultimate ruling on the injunction. I anticipate an immediate appeal to the Third DCA by Take-Two”

Thompson is referencing Florida’s Third District Court of Appeal. He is correct that the ruling is unprecedented, although in the long run it’s really not a win if it gets overturned on appeal.

GP has confirmed with Judge Friedman’s clerk that Thompson’s version is correct. She added that the Judge will view the game in chambers beginning tomorrow afternoon and is prepared to spend several days watching its content.

The clerk added that the hearing was not contentious, and that it was covered by the Miami Herald as well as a local TV news crew.

What this means is that Judge Ronald Friedman is saying he needs to see Bully in order to rule on Thompson’s claim that the game is a “public nuisance.” He’s given Take-Two 24 hours to produce it for the court’s review.

UPDATE: Witnesses Named in “Bully” Court Case

If nothing else, Jack Thompson can say he hauled Bully into court.

Later today, attorneys for publisher Take-Two Interactive along with those representing retailers GameStop and Wal-Mart will appear in a Miami courtroom to defend Rockstar’s upcoming game from Thompson’s unprecedented bid to have its sale blocked in Florida.

Thompson’s claim that Bully constitutes a public nuisance will be heard by Judge Ronald Friedman. The Florida statute in question defines such a nuisance as something that:

tends to annoy the community, or…
injures the health of the citizens in general, or…
corrupts the public morals
Such laws are commonly used against brothels and gambling operations. Applying the regulation to a video game is certainly new - and rather dubious - legal territory.

Last Friday Thompson offered to cancel today’s hearing if Take-Two would overnight him a copy of Bully for him to evaluate. Obviously, that didn’t happen. Game blog Destructoid will apparently have someone covering the 1:30 hearing, so check there for eyewitness reports.

UPDATE: Thompson has circulated an e-mail to GamePolitics and other news outlets naming two “expert witnesses” he plans to call today. They are:

Dr. Eugene Provenzo, University of Miami professor; in 2005 Dr. Provenzo told GP that he and Thompson were collaborating on a book called, oddly enough, Public Nuisance: A Primer for Social Activists. No word on where that project stands.

So Rockstar has to get a FINAL copy of Bully within 24 hrs? Isn't this bad? Won't they have to rush it or is it finished?

Would it just be banned in Florida, or all together. If he wins, which he won't!!!! I don't live in Florida, so if it gets banned there, it doesnt effect me at all.

Jack thompson will not win, the 100% version will prolly have some bugs so it wont matter, once he (and the judge) see that this is just another fun little game, itl all be over. so, dont worry guys, i know that it wont be banned, it cost R* alot of time and money for bully, their not just gonna let that go away.

Unless you live in Florida this doesn't mean anything to you. And it's not as if there won't be tons of copies that can be ordered off Amazone or eBay in the unlikely event that Bully does get banned in Florida. Even if it does, that'll only boost sales in other states and around the world.

And it's not iff Take Two won't have their lawyers there making sure that Bully gets a fair shake and pointing out that really bad behavior gets you punished but good.

I'm thinking Jack will have been laughed out of court by Tuesday.

As soon that the judge sees and laughs at this game for its comedy (that i hope will put him/her in a good mood) she will call off the hearing and let this game pass!

1.  If anything, it would only be banned in Florida because from what I've heard and seen proof of is that Thompson can only practice law in Florida.

2.  The game is currently 4-5 days away from release, and is actually 100% finished.  The reason I know this is because http://www.1up.com will have a full final review up tomorrow.

3.  He won't win anyway.  The ESRB has already given the game a Teen Rating.  As a matter of fact, they were court-ordered to give the game a full review multiple times throughout it's development and had already decided on a final rating over two months ago.

BREAKING: Florida Judge Has Viewed “Bully” - May Rule Tomorrow

Will Miami-Dade Circuit Court Judge Ronald Friedman give Bully a wedgie?

Or will he decide that the game is not a public nuisance under Florida law?

We may know as early as tomorrow. GamePolitics has received another of those terse Jack Thompson e-mails. This one says:

“Judge Friedman has seen the game played with me present, and… he has granted my motion to reconvene the hearing at 1:30pm tomorrow.  After argument by both sides, he will rule.”

Judge Friedman, of course, ordered Take Two officials to show him the game in chambers today at three o’clock. Thompson’s e-mail is stamped 7:47, so the judge had at most a little over four hours of watching the action at the game’s fictitious Bulworth Academy.

Washington Post: “Bully” Ruling a “Major Coup” for Jack Thompson
A major coup…”

That’s how Washington Post reporter Mike Musgrove characterized Jack Thompson’s Bully win yesterday in a Florida courtroom.

“My view is that the game potentially impinges on public safety,” Thompson told Musgrove. “I’m pretty sure that the game is harmful to minors.”

Representatives of the video game industry defendants did not respond to the WaPo’s request for comment.

In other coverage, the Miami Herald, which had a reported in attendance, offered insight into Judge Ronald Friedman’s take on Bully.

According to the newspaper, Judge Friedman told the court that he needed to see how violent the game was before rendering a decision. Surprisingly, Friedman said that, while he could not change the ESRB rating, Bully “may be so bad that something has to be done.'’

Thompson - accurately - called Judge Friedman’s order unprecedented:

‘’I'm not aware of a judge ever ordering the production of a game prior to its release for any reason.”

Judge Frieman also admonished an attorney representing Wal-Mart to have the mega-retailer reconsider sales to minors if he - Judge Friedman - decides it should carry a mature rating.

Wal-Mart exec John Simley told the Herald, ‘’There’s no question we would do exactly that.”
