So I was looking through my bully videos on youtube and found out my first teleport mod video had a song copyright warning. I use bully music for most of my bully videos so it was unexpected to see that warning. According to youtube I used a song called "Lonesome Heart Swing" by Dennis Caplinger, but the song I used was the one that plays on the radio in the janitor's room.

Listen around 1:07 and you will notice it's the same song.
I always thought that Shawn Lee composed all the songs with the exception of the christmas themed and music class songs. The song is from 2004, 2 years before bully came out.

Well, that Sucks.
Rockstar must have licensed it from whomever.
Kind of a dorky song anyway.

Shawn Lee probably sampled from that song, since he usually does that when it comes to songs that don't really fit his "musical style".
Either that, or he asked/paid the original author for permission, then forwarded the license over to R* for them to use it in the game.
I think the fair use should still be applied even in your case, regardless of what Youtube's auto detection says.
If the preppies fight theme is covered in fair use, then so should this track.
